On the other hand, the Anti-Corruption Strategy was approved by the Government in December 2020. Four webinars that presented worldwide anti-corruption practices and concrete examples in fighting corruption were held with a total number of 102 participants. In addition, more than 50 judgements related to corruption offences were observed for Sentencing Guidelines. The government adopted the National Anti-money Laundering Risk Assessment while the Board of FIU approved the Money Laundering Strategic Analysis Needs Assessment defining competencies, staffing and timeline for the new Unit within the FIU. 1.2.1 An online platform was established for the Anti-corruption Agency to monitor the implementation of the Action Plan and for responsible institutions to upload their progress. Despite the lack of implementation by the AoK, KACA has agreed organize a meeting with all institutions and discuss modalities for implementation of activities. SAEK introduced articles defining the scope of integrity plans, responsible authorities and the monitoring system. Moreover, an e-monitoring tool was developed by which municipal and central level authorities can upload their integrity plans and the same can be monitored for effectiveness and progress by the KACA. 1.3.1 The drafting of the Strategy will begin in third year and completed in the fourth year. 2.1.A comprehensive curricula for Anti-Corruption Training Program was prepared and up to 10 trainers will be trained in various topics in combating corruption. In order to promote and improve Public Private Partnerships on combatting financial crime, two webinars were held in July and December for representatives of Kosovo’s private sector, police, tax and customs investigators, prosecutors, judges and FIU officials with more than 340 participants. A number of webinars were held to determine the scope and mandate of the new Strategic Analysis Department at FIU and the needs assessment defining the competencies was adopted by the FIU. A roundtable was organized jointly with the EU Office to discuss the draft the Law on Political Party Financing and the Venice Commission comments, which was the first public event that MPs disclosed their positions on the draft law. The expert to develop functional specifications for the Notarial Case Management Platform has been engaged. The Platform shall allow tracking of notarial transactions with the TAK / prosecutorial platform and the Financial Intelligence Unit but also improve daily notarial operations, and improve supervision by the Ministry of Justice. 2.2 Chief Prosecutor of Kosovo signed an MoU with the Basel Institute on Governance by which a specially assigned prosecutor will have access to case files and support investigations into assets recovery cases. ROLAG provided support, advice and facilitation of communication SPRK, the Office of the Chief Prosecutor and the Basel Institute. In addition, ROLAG has been working closely with the Judicial Academy and the Basel Institute on curricula development. A training program was prepared and approved by Academy of Justice to enhance the capacity of investigators, prosecutors and judges in Kosovo to successfully investigate, prosecute and try corruption and money laundering cases, and recover assets 2.3 GAP Institute published analysis on the Draft-Budget 2021: Favouritisms and Discriminations of the Municipalities, Regarding Capital Investments”, to analyze the distribution of capital investments of ministries to municipalities, in order to identify whether there has been any favouritism or discrimination towards municipalities, on a party basis. In order to mark the Anti-Corruption Day, GAP Institute organized the Students’ Essay Competition of Public Finance. A total number of 28 applications were submitted and the award ceremony for the 4 winners was organized with participation of donor representatives, UNDP management and the wider public. On the other hand, the draft law on Declaration of Assets was approved only by the Government. Both draft laws are expected to be approved in the first half of 2022. The Concept Document on Court Appointed Experts has been completed in November 2021 and the Ministry of Justice has sent the draft for preliminary consultative process as well as in the platform for public consultation. The concept document is expected to be approved in the first quarter of 2022. SAEK has also supported the MoJ in the development of the Draft Law on the State Bureau for Verification and Confiscation of Unjustified Assets and provided comments to the MoJ on the package of laws related to prosecutorial system. To mark the international anti-corruption day, SAEK III published 3 animated videos showing the results of the four beneficiary institutions, whereas one video was completely dedicated to gender and anti-corruption and the importance of women inclusion in anti-corruption policies. Following the adoption of the Sentencing Guidelines in June 2021, ROLAG has been monitoring its implementation. ROLAG has to date analysed 141 judgements, out of which 100 were convicting judgements. 1.2.1 Four experts were contracted for analysing and drafting four specific sections of the Anti-Corruption Strategy: Political, Rule of Law, Public Administration, Procurement and Management of Public Finances. The results of the analysis will be shared with KACA and the Working Group once it is established. The strategy is expected to be approved during 2022. The Technical Expert to KACA and Technical Expert to the Chief State Prosecutor continued to provide their expertise. Their contract is valid until 25 and 28 February respectively. The Report on Gender Equality Related Corruption Risks and Vulnerabilities in the Civil Service and the Private Sector was published and a launch event was organized on 7 of December, with participation of representatives for Government institutions, international organizations and civil society. 1.2.2 5 The expert on integrity plans developed and delivered the draft-methodology for integrity plans and a three-day training of trainers was held in September for 15 officials from KACA. 1.3.1 This activity will be initiated in the last year of the project. 2.1.1 During the period January-June 2021, the prosecution had 453 criminal charges against 715 persons. The project supported the development of a curriculum for corruption offences which is targeting professional associates (legal advisors) and legal officers (legal clerks) in courts and prosecution offices. The Curriculum has been published by the Academy of Justice in December 2021. 2.1.2 Basel Institute offered an online training on cryptocurrencies for law enforcement agencies (LEAs), prosecutors and representatives of Financial Intelligence Units (FIUs) engaged in financial investigations, prosecutions involving economic crime and the recovery of illicit assets. The FIU and project staff discussed with banks and other private sector reporting entities the findings of Kosovos National Risk Assessment (NRA) and the role of the private sector in implementing measures from the accompanying Action Plan. In 2022, will be organized a series of roundtables with the private sector developing corruption money laundering indicators, a risk assessment of the banking sector, and support companies in developing collective action initiatives to jointly level the playing field for procurement contracts and PPPs. 2.1.3 The Strategic Analysis Department has become operational during the reporting period. The Department has proactively begun analyzing financial and economic data to identify money laundering schemes and trends in several areas. 2.1.4 Basel Institute on Governance, has developed a specially designed ToT curricula for investigators on assets recovery. The in-person training has been rescheduled for the first quarter of 2022. 2.1.5 The project has developed functional requirements together with representatives of the MoJ and the Chamber of notaries. The development of the functional requirements is completed and were presented to both Ministry of Justice and the Chamber of Notaries. Both institutions have shown readiness to cooperate in the development process of the platform. 2.2.1 During the period January-June 2021, 7,691,591.36 € were frozen or sequestrated. Through SAEK and ROLAG facilitation, the designated experts from the Basel Institute have held a series of coordination and operational meetings in October and November with the Chief Prosecutor, Head of the Special Prosecution, and special prosecutors on exchanging information on cases. The SPRK has submitted six (6) cases to the Basel Institute for further technical assistance, including one grand corruption case involving multiple foreign jurisdictions. A series of meetings of ROLAG with the National Coordinator for Fighting Economic Crime were held which resulted in the establishment of know-how forum comprised of Confiscation Coordinators, including two additional prosecutors from the SPRK International Legal Cooperation Coordinators, Prosecutors from the three biggest Prosecution Offices in Kosovo and CSOs dealing with justice system reform in Kosovo as well as Basel Institute. 2.2.1 During the period January-June 2021, 680,356.56 € were confiscated. An MoU was drafted by ROLAG to transfer the Asset Recovery Office from the Kosovo Police (KP) within the structures of the Kosovo State Prosecutor (KSP), as well as an internal Draft Regulation on the Establishment of the Asset Recovery Unit which determines the organization, manner of work, activity and competencies of the Unit and sent it out for comments from stakeholders. 2.3.1 100 irregularities observed and found within the monitoring the transparency and allocation of the “Economic Recovery Package”; The main findings of the Report on the Economic Recovery Package indicate that the institutions responsible for the implementation of these measures have not been transparent during the distribution of funds, with measures not known for many beneficiaries, and unknown amounts allocated for others. In addition, the criteria for the implementation of these measures were designed in a way that it did not take into account the impact from the pandemic for benefiting the financial assistance. Therefore, the assistance distributed through most of the measures was proportionate to all beneficiaries, rather than classifying as eligible to benefit only businesses and citizens affected by the pandemic. Improved transparency as the published infographic reached 6.934 people on social media. As a result, citizens’ increased awareness regarding the criteria for the implementation of measures from the economic recovery package will drive the institutions for enhanced accountability. 2.3.2 50 applications for the best essays in the field of public finance as a part of International Anti-corruption Day Youth engagement and involvement in important discussions such as public finance, confiscated assets and public finance with specific regard in women’s inclusion. Students were encouraged to submit critical essays as an opportunity to contribute to the sector of public finance. Throughout the reporting period, 631 reports were received, 429 follow-ups with institutions out of which 313 were about access to public documents, 8,141 articles were published on KALLXO.com, 3 series of “The Prosecutor” TV programme was aired, 18 web TV were launched. Around 50 legal complaints were submitted to the Tax Administration of Kosovo as a result of BIRN’s work together with citizens in tackling tax evasion. As a result of KALLXO.com reporting, which was based on tip-offs from the public, 137 businesses were fined over 102,000 euros due to irregularities. The legal office of KALLXO.com sent 20 cases to the State Prosecutor’s Office while the investigation for 16 of them has already begun. 3 cases were sent to the KACA, two of which started investigations, while in one case the subject was forced to resign from the position held and consequently the case was completed. A judge was suspended and disciplinary proceedings were initiated against the prosecutor regarding the case of a 15 years old that was sexually abused. Eight (8) letters were sent to the Tax Administration of Kosovo due to abuses of workers’ rights and tax evasion, while two (2) letters were sent to municipal inspection directorates; 2to the Anti-Corruption Agency, and one to the Kosovo Ombudsperson. As a result, indictments were filed against 5 high-profile officials, including individuals that were convicted of corruption and undue influence, as well as violations of tax regulations. More than 10 individuals were arrested, and dozens of indictments featuring organized crime and corruption charges were initiated as a result of our reporting. Disciplinary proceedings were also initiated against more than 10 prosecutors, judges and public officials. Meanwhile, a total of 14 recruitment processes for senior positions in Kosovo’s institutions were monitored, as were recruitment processes for around 400 Kosovo Security Force soldiers. As a result of receiving 40 citizen reports relating to tax evasion, employees working without contracts, and businesses operating without cash registers or proper registration, 30 official requests were submitted to the Tax Administration of Kosovo (TAK) reporting these issues. It is a document whose purpose is to establish a common vision for the future of a community and then determine policies that will help attain that vision. While its key purpose is to address the physical development of a community, it can address economic and social development issues. 6 grants will be provided to NGOs/CSOs with previous experience working on cultural heritage/traingin and skills development/arts and crafts production to engage with women and youth. Out of 90 estimated participants, estimated 75% of beneficiaries will be women and girls. 15 individuals from the most vulnerable groups will be encouraged to register with Employment Office to be able to benefit from the Action. The project will support the establishment of the entire unexplained wealth confiscation system in Kosovo through a three pronged approach. First, the project will support public outreach efforts to explain the necessity and aim of confiscating unexplained wealth, including assuaging concerns of arbitrary confiscation of citizens’ rightfully owned property and combatting fake news from wealthy business and political lobbies that have a vested interest in retaining their wealth derived from corruption through maintaining the status quo. Second, the project will support the establishment of the Bureau through policy advice on internal processes and structures, transparent recruitment procedures, effective internal oversight and capacity building on undertaking unexplained wealth investigations. Third, the project will provide capacity building to judges tasked with hearing cases involving unexplained wealth to ensure proper implementation of the law and full legal safeguards.
